PARK 8 CENTER, LLC (dba – P8 Sports Plex) 8800 W Sam Houston Parkway S, Suite 107 ◊ Houston, Texas 77099 CONTINUING GENERAL RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT In consideration of me or my minor child named below being permitted to participate in, attend and/or observe any activity conducted by Park 8 Center, LLC (dba – P8 Sports Plex) (hereinafter, “P8”) in connection with any of its business operations or activities, regardless of whether conducted at P8’s facility at the address above or any other locale, I am voluntarily entering into this Continuing General Release and Waiver of Liability, Assumption of Risk, Indemnity Agreement and Agreement to Arbitrate (the “Agreement”). I represent that I have had and am satisfied with the opportunity to make all inquiries necessary regarding the P8 activities in which me or my child shall participate. By signing this Agreement, I acknowledge and represent that I fully understand that P8 operates an athletic business and those activities include inherent risks and the possibility of significant physical/bodily injury exists and I fully acknowledge and understand these dangers and risks and without qualification accept and assume all such risks and danger and all responsibility for injuries (temporary, permanent and life-ending), losses, costs and damages I or my child may incur. I represent and warrant that I and/or my child named below am/is qualified, in good health, and in proper physical condition to participate in such activity. I represent and warrant that if I believe any elements, events or conditions of such activities are unsafe or I am or my child is unable to perform such activities, I will immediately discontinue my or my child’s participation in the activity. Without qualification or exception, I hereby individually and/or as legal representative of my child RELEASE, FOREVER DISCHARGE and COVENANT NOT TO SUE P8 and its owners, directors, officers, employees, agents, volunteers, sponsors, other participants (teams, coaches and athletes), advertisers, and if applicable, owners and lessors of premises on which the activity takes place (individually and collectively “The Released Parties”) from any and all claims, demands, costs, expenses, liabilities, losses, or damages (individually and collectively “Claims”) I and/or my child may suffer caused by, related to, in connection with or arising out of any damage (physical or property), injury (temporary, permanent or life-ending) or loss of any type or nature whatsoever (individually and collectively “Loss”). Without qualification or exception, and to the greatest extent permissible under applicable law, I agree to protect, defend, indemnify and hold harmless The Released Parties from and against any and all Claims, court and/or arbitration costs, and any and all Claims related to any medical expenses of my child whatsoever that any of The Released Parties may suffer which are caused by, related to, in connection with or arising out of any Loss of any type or nature whatsoever suffered by me or my child as a result of my child’s participation in, any P8 game, event, program or activity, including observation of or attendance at an P8 game, event, program or activity, regardless of whether same game, event, program or activity is or was conducted at P8’s facility at the address above or any other locale. This obligation for indemnity expressly applies to any claims for P8’s actual or alleged negligence. I further agree, that in the event P8, in its sole discretion, shall determine if necessary, it may retain the services of an attorney of its choosing which may be separate and apart from and in addition to any attorney provided by any insurer to represent P8 and/or any other of The Released Parties I have agreed to indemnify herein in connection with any matter for which I have agreed to indemnify The Released Parties, and that all costs and expenses attendant to that representation, including expert witness charges and reasonable attorney’s fees based upon the experience of said experts and attorney and the time spent by said parties on such representation, shall also be costs and expenses for which I have agreed to provide indemnification herein. I hereby grant P8, its contractors, representatives or employees the right to photograph or record me or my minor child and grant P8 permission to use any photo, recording, voice of me or my minor child as well as our physical surroundings for any lawful purpose, including, by way of example only, such purposes as publicity, illustration, advertising and internet-based content. I hereby release and hold harmless P8 from any reasonable expectation of privacy or confidentiality, for myself and on behalf of my minor child, associated with the images specified above. I further acknowledge that my and my child’s participation is voluntary and that neither of us will receive financial compensation of any type associated with the taking or publication on these photographs or videos. I further authorize P8, its assigns and transferees to copyright, use and publish the same in print and/or electronically. By signing below, you represent and affirm that you have legal custody of the below referenced minor child. Should your child need emergency medical treatment at a time when he or she is not accompanied by either parents or legal guardians, and it may not be feasible or practical to contact them, by signing below you grant your authority for P8 and any of its employees, contractors, agents, or representatives (the “Designated Agent”) to administer general first aid treatment for any minor injuries. If the injury or illness is life threatening or your child is in need of emergency treatment, you hereby authorize the Designated Agent to summon any and all professional emergency personnel to attend, transport, and treat your child and to issue consent for any X-ray, anesthetic, transfusion, medication or any other medical diagnosis, treatment or hospital care deemed advisable by any licensed medical professional or hospital. Further, you agree to assume all financial responsibility for all expenses of such care and agree to hold the Designated Agent harmless from any and all claims related to the injury or the medical treatment provided. I represent and warrant under penalty of perjury that if a separate copy of the Agreement bearing the signature of my child’s other parent is not delivered to P8, that either: (1) my child’s other parent is no longer living; or (2) that after consulting with an attorney licensed and practicing law in the State of Texas, that my child’s other parent, although living, has no legal rights to consent or object to any matter affecting or concerning my child, and further has not rights to any claim of my child’s, and/or my child’s participation in any P8 activity, and/or the actions I have taken by signing this Agreement that directly, substantively, and permanently affect my child’s legal rights. By signing this agreement, I also represent and warrant under penalty of perjury that there is no other person who should be or should have been consulted concerning my signing this Agreement on behalf of my minor child. I further acknowledge that EP8 is relying on the statements made herein in allowing me or my child to participate in the activity. It is my intent that this Agreement constitute and at all times be interpreted in every manner as continuing with regards to all matters contained herein and shall not limited to or for a single instance. By signing below I represent and warrant that (1) I have read the Agreement, (2) I understand it, (3) that I acknowledge, understand and agree that I, individually and as legal representative on behalf of my child, am giving/have given up substantial legal rights by signing it, (4) I have signed it freely and without any inducement or assurance of any nature, (5) I intend it to be a complete and unconditional release and waiver of all liability of The Released Parties to the greatest extent allowed by law and agree that if any portion of this Agreement is held to be invalid the balance notwithstanding such determination shall continue in full force and effect. A Waiver must be completely filled out by each participant or the participant’s representative, in the event of a minor, and signed in order to participate in any activities at P8’s premises or any locale where P8 is conducting an event. IN WITNESS WHEREOF, the undersigned, individually and/or as parent and/or legal representative of the Minor Child identified immediately above, after having completely read this Agreement, by signing below does hereby agree and covenant to be legally bound to and by this Agreements and all terms and conditions contained in it.
